Gordon?s appeal focuses on disparity between ?A? and ?B? bottle tests

    http://profootballtalk.nbcsports.co...es-on-disparity-between-a-and-b-bottle-tests/

For Gordon, the ?A? bottle showed a concentration of 16 ng/ml, only one nanogram per milliliter above the limits of 15. The ?B? bottle showed a concentration of 13.6 ng/ml ? less than the threshold.

But because the ?A? bottle was labeled ?A? and not ?B? and because the ?B? bottle was labeled ?B? and not ?A?, the end result is a positive and a minimum one-year banishment from the NFL. Flip the bottles when it?s time to apply the labels, and Gordon isn?t facing a suspension.

Let's throw out the discrepancies in bottles for one minute and go to the World Anti-Doping Agency changed the threshold 2 years ago from 15ng/ml to 150 ng/ml due to scientific proof that this would be closer to the threshold of 2nd hand smoke.

Since that time all other sports agencies around the world have followed suite...except the NFL....

Time to change and time to give Josh Gordon a pass on this one!!

Although, he still needs to focus more on the company he keeps and this would not be an issue to begin with..Move on from this issue and give him a 2 game suspension for his DWI!! The current policy, I believe, is a 1 game suspension for first time DUI. However with his past issues, doubling that would be adequate.

I look for at max a 4 game suspension .

if Ratbird Ray Rice can knock his GF out and only get two games then Gordon should get only two to four .I only say that because of the DUI he got which was also barely over the limit .

Josh Gordon has made terrible decisions for a lengthy period of time, while knowing full well that he was in the public and league eye. The NFL certainly doesn't appreciate that negative attention, nor do they appreciate a player who obviously hasn't learned anything. It's hard to say a guy deserves a break when he shot himself in the foot at every turn. Did he kill anyone? No, but he consistently broke league rules. Doesn't matter whether you like them or not, dude broke 'em.

so did Colts owner Irsray ..I say there is a double standard then

Not disagreeing with you. But taking it from the NFL's standpoint, as far as I understand it, it's the players who have to follow these rules, not the owners.

    To add to dline's response . . .

The players work under the Collective Bargaining Agreement (CBA) in which these rules are stated. The owners do not fall under the scope of the CBA.

So, yes Bluez, there are different standards.

He has made a couple of bad decisions, no denying that...but the numbers don't tell the story you are trying to paint of him shooting himself at every turn...

He has had over 70 drug tests since he entered the league, barely two years ago July 12, 2012...

Out of those 70 tests, he passed 68 of them with flying colors...one he tested positive for Codeine, from cough syrup, the other he tested positive in one of the two split samples...one 16 ng/ml, which is one BILLIONTH of a gram over the limit, the other he was 13.6 ng/ml which is under the limit. Had the bottles been marked opposite, he would not have even tested positive.

This flies in the face of the ENTIRE sports world who use a scale of 150 ng/ml for testing... (edit: oops, math was way off) TEN TIMES the amount Gordon's test showed up.

Yes, he made mistakes a plenty...but this one is not irrefutable by any means. If the facts as reported are accurate, there is no way this doesn't get reduced.

Except that the commissioner of the NFL has publicly stated on more than one occasion, the owners should be held to a HIGHER standard AND more importantly, that same commissioner does have disciplinary rights to those owners. So going off of HIS words, the CBA should be a minimum guideline, when it comes to the owners.

I know, that isn't enforceable, just my two cents.

That's what I thought I was saying. Perhaps I should have said, "The players work under the Collective Bargaining Agreement (CBA) in which these rules and the consequences are stated."

  11. I completely agree with you that his suspension should be at most 2-4 games. However, I just wanted to add that over BAC is over the BAC, I feel like how far over shouldn't apply. A bad decision is a bad decision.

  12. Irish we all know how much u like the Browns.....which is fine, but to say he has passed 68 out of 70 tests w flying colors is crazy....most guys(90%?) go through their whole career w/out failing a test and this guy did it twice in 2 yrs and thats not even counting how many times it happened in college....he is like a cat w 9 lives and hes probably on 6 or 7 rite now...btw, like the NFL said it doesnt matter how much ur over there are guidelines that need 2 b followed

  13. IrishDawg42 Legend Manager Browns Buckeyes Fighting Irish

That's true except when it pertains to science proving that 2nd hand smoke is closer to 150 ng/ml, which is why every other sports governing body on the planet has gone to that measurement and the NFL hides behind the CBA as a reason to keep it at 15 ng/ml...If 2nd hand smoke is 150 ng/ml, then 15 ng/ml would most likely be like going to a concert and coming out of the gate and taking a drug test...in an open air venue...

In which case, they are sadly mistaken and should correct it as everyone else on the planet has...

  14. IrishDawg42 Legend Manager Browns Buckeyes Fighting Irish

That is precisely what I AM considering Stopper...We are talking about a guy who failed 3 in college, the 3rd of which put him into the NFL abuse program to begin his career...

Since that time he failed one for codeine, which in turn gave him a reduced punishment, and another in which he would have passed every drug test known to civilization EXCEPT the NFL..INCLUDING the US GOVERNMENT!!

They are well beyond over due to re-write those guidelines, and even if they don't, one of the two split samples was under the limitations. To say he was barely over the rules, really isn't even the case here...one of the two bottles was 1 billionth of a gram over the rules, the other split sample was well under...

So, since his arrival, it could be argued he has really only failed one test...then you also have the issue of the DWI, which I believe wholeheartedly he should receive a suspension for.

  15. I can agree w that, but rite now those r the rules that are in place so players must pay the penalty for being in that environment/setting

Let's not confuse what he's using as a defense with what is reality. You'd have a hard time convincing me his test actually came from second hand smoke and not him smoking himself but let's assume for the sake of arguing that it's true. Didn't the guy that was with him when he got his DUI 3 1/2 weeks ago have pot on him? He failed a test thanks to second hand smoke and is facing a year suspension but he doesn't stop hanging out with pot smokers?

There's where my issue lies. It seems like his name has been in the news every third week since the draft for doing something illegal/against league rules. If it were this one incident, despite still breaking league rules, you might have a sympathetic ear. But as it stands, this guy clearly hasn't learned any lesson. I haven't really gotten into all of it - haven't particularly cared (what good is my speculation?). But from everything I've heard, he deserves a suspension. This is a real nice try to get out of something, but honestly, there's a lot more where this came from. For the first time in a long time, I agree with Beach's sentiment above.
